Waiver and Release of Liability for Use of Infrared Sauna

AGREEMENT, WAIVER, AND RELEASE OF LIABILITY

  • The use of drugs, medication, or alcohol prior to or during the sauna session may lead to dizziness or unconsciousness.

  • Please consult your physician if you are in doubt about your ability to use the sauna.

  • No guests under the age of 18 are permitted in the sauna.

  • Please discontinue the use of the sauna if you feel light-headed, dizzy, or heat-exhausted.

  • Sauna sessions should be limited to a maximum of 45 minutes at one time. Please take breaks throughout your sauna session if needed.

  • It is advisable to drink water before, during, and after the sauna session.

  • It is advisable to wait at least one to two hours prior to your sauna session to avoid any ill feelings.

  • It is advisable to shower prior to your sauna session.

  • If you have an open wound, you will not be permitted to use the sauna.

  • Guests using any medications must consult a physician or pharmacist prior to the use of the sauna.

  • Pregnant women are not to use the sauna unless they have written consent from their doctor.

  • Do not use any lotions, make-up, or chemicals prior to the sauna session. These items may block pores, affect perspiration, stain the wood in the sauna, or cause irritation to other guests.

  • It is solely your responsibility to monitor your body and its reactions and determine if it is appropriate to use the sauna. You alone are responsible for your safety and well-being.

AGREEMENT

  • I acknowledge and accept the risks inherent in the use of the sauna.

  • I voluntarily assume the risk of injury, accident, or death that may arise from the use of the sauna.

  • I and any of my heirs, executors, representatives, or assigns hereby release The Esplanade Torquay from all claims or liabilities for personal injury or property damages of any kind sustained while on the premises, during the use of the sauna, and from any advice provided by an employee of The Esplanade Torquay.

  • I agree that this Application and Waiver is in effect for all sauna sessions with The Esplanade Torquay and will not expire unless requested by either party.

  • I understand it is my personal responsibility to consult with my doctor regarding my participation.

  • The Esplanade Torquay does not provide medical advice or treatment. Far-infrared sauna use may or may not be appropriate for you. Please consult your healthcare provider for medical advice. The information provided is for general informational purposes only and does not address individual circumstances or medical conditions. Do not attempt to self-treat any disease with a Far-infrared sauna.

IF YOU FEEL UNWELL, DIZZY, OR LIGHT-HEADED, PLEASE LEAVE THE SAUNA IMMEDIATELY.

TERMS AND CONDITIONS

  • All reservations must be scheduled ahead of time.

  • If you need to cancel, please let us know 24 hours prior to your reservation.

  • A separate signed Waiver and Release of Liability form is required before using the sauna for the first time.

  • A bathing suit or activewear (such as bike shorts/crop tops) must be worn during your session at all times.

  • We ask that you sit on a towel while in the sauna and wipe the seat and backrests when leaving to be considerate of the next guest.

  • We ask that you arrive 5 minutes prior to your reservation.

  • We ask that you be respectful of others, The Esplanade Torquay team, and our property. If at any time we feel that the members, staff on-site, the equipment, or the space is not being respected, The Esplanade Torquay team members can ask you to leave. You will not be refunded.

  • No food is to be taken into or consumed in the sauna.

CONTRAINDICATIONS FOR INFRARED SAUNA USE

Using Far-infrared saunas may put you at risk if you do not fully understand how to use them. It is not recommended to attempt to self-treat any disease with a Far-infrared sauna without direct supervision of a certified physician. If any of the conditions listed below apply to you, consult with your physician before using a Far-infrared sauna.

General Considerations:

  • Hydration is a requirement for sauna use. Drinking water or advanced electrolyte replacement water is recommended before and after sauna use. (Caffeinated beverages are not recommended as they dehydrate the body.)

Medical Conditions Requiring Caution:

  • Medications: Individuals using prescription drugs should seek medical advice for possible interactions with Far-infrared waves or elevated body temperature. Some medications may impair the body's natural heat loss mechanisms.

  • Cardiovascular Conditions: Those with hypertension, congestive heart failure, impaired coronary circulation, or on blood pressure medications should exercise extreme caution.

  • Alcohol: Alcohol intoxication decreases judgment and may increase the risk of heat stress.

  • Chronic Conditions: Conditions such as Parkinson’s, Multiple Sclerosis, and Diabetes with Neuropathy can impair sweating.

  • Haemophiliacs & Individuals Prone to Bleeding: Should avoid infrared sauna use.

  • Fever or Heat Insensitivity: Those experiencing fever or an inability to sense heat should not use the sauna.

  • Pregnancy: Pregnant women should consult a physician before using the sauna.

  • Joint Injuries: Recent injuries should not be exposed to heat for the first 48 hours.

  • Implants & Pacemakers: Metal implants reflect infrared waves and may not be affected, but consult a physician. Pacemakers and defibrillators may be affected by sauna magnets.

WAIVER AND RELEASE OF LIABILITY FOR BREATHWORK & ICE BATHS

Before attending a breathwork and/or ice bath event/workshop, read the following information and seek medical clearance if required.

Assumption of Risk:

  • I acknowledge that participation in Cold Water Immersion/Ice Baths involves inherent risks, including hypothermia, heart attack, respiratory stress, skin reactions, cold water blackouts, and shock.

  • I understand and appreciate these risks and agree to participate with full knowledge and understanding.

  • I declare that I am in good health, have no conditions affecting my ability to participate, and have not been advised otherwise by a healthcare professional.

Medical Clearance Required for Ice Baths if You Have:

  • Heart conditions

  • High blood pressure

  • Raynaud’s Disease

  • Cold urticaria (cold allergy)

  • Migraine

  • Epilepsy

  • Pregnancy

  • Recent operations

Medical Considerations for Breathwork Sessions:

  • Pregnancy

  • Glaucoma/detached retina

  • Brain surgery, significant head injury, severe migraine

  • High blood pressure

  • Cardiovascular disease

  • Lung disease, pneumothorax, emphysema, pulmonary edema

  • Thyroid condition

  • Diabetes

  • Asthma (bring an inhaler)

  • Epilepsy

  • Perforated eardrum, ear surgery, hearing loss

  • Mental health conditions that may be exacerbated by emotional release

ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY

This Agreement is entered into between The Esplanade Torquay and the undersigned. Participation in any training, breathwork, or ice bath activity is contingent upon this agreement.
